Bean Bags Australia Terms & Conditions Informations
BY USING OUR WEBSITE AND BUYING FROM OUR STORE, YOU AGREE THAT YOU HAVE READ AND UNDERSTAND THE FOLLOWING CONDITIONS:

N.B. All instances where "BBA" is used in text below or anywhere on our website are to be taken as an abbreviation of Bean Bags Australia.

1. Confirmation of Order
Confirmation will be sent to the email address provided during checkout shortly after placing an online order. Orders placed by phone will receive a confirmation number. We make every effort to ensure the accuracy, timeliness, and reliability of the information is provided on our website and in our emails. Please carefully review the order information and immediately contact Bean Bags Australia if any errors are found. Bean Bags Australia makes an effort to prevent, but does not assume responsibility for misquoted prices, payment, availability, and product information, resulting from technical, human, or communication errors.

2. Delivery information
Once Bean Bags Australia has received your order we will attempt to despatch the goods within 21 days of payment of order. Our bean filled furniture is made to order overseas and delays may occur if supply of any materials are not immediately available from the manufacturer. If for any reason we are unable to supply you within this timeframe, we will contact you with an estimated delivery date and you will have the option of changing or cancelling your order. This can also be done through your account section as long as the order is unlocked. All orders will be sent by air where possible. Bean Bags Australia accepts no responsibility for any delivery delays or inconvenience caused by freight carriers where the problems are beyond our control. If the package arrives damaged you must notify us immediately so we can process your claim and resend you a replacement product.

Please ensure that the postal address you provide when you make your order has full disclosure and that accurate delivery details are given. Failure to provide accurate delivery information could result in costs being absorbed by the you the customer for any liability from re-directed freight costs and replacement of items if necessary. If an attempt has been made to deliver your order and the delivery company fails to hear back from the recipient within 30 days, the recipient or the purchaser may be liable for any return postage fees incurred by Bean Bags Australia. All orders sent by us are via the standard registered post, with signature request, and insured for total replacement and recovery of freight cost at lodgement. Bean Bags Australia does not accept responsibility, nor liability for any losses that caused by delivery delays, damage or theft beyond our control in any stage of the shipping; however we will endeavour to assist and remedy any situation that is within our means of influence.

Freight to destinations outside Australia can incur a wide range of varying cost factors. Bean Bags Australia normally does not deliver to countries or regions outside of Australia's states and territories without prior arrangement by email to shop@beanbagsaustralia.com.au.

3. Payment
Orders will not be processed and goods will not be delivered unless we receive prior approval of payment with your order, (except in the circumstance where prior arrangements and agreement has been made with us). We currently accept payment with PayPal as the preferred payment method for the guarantees they provide to both the customer and the vendor.  All orders are processed in Australian (AU$) dollars.
(a) If provided, the overseas currency equivalent is indicative only;
(b) The final amount billed is in Australian (AU$) dollars  at the relevant exchange rate, and hence is subject to currency fluctuations if purchasing from outside Australia. Bean Bags Australia does not process sales from countries other than Australia if the order is to be shipped to destinations outside Australia.

4. Cancellation of orders
Our products are custom ordered from our manufacturer and we do not stock bulk quantities of products. Therefore, due to the extra costs for freighting and storage charges, we cannot take back into stock returns for unwanted orders . Only under exceptional circumstances, such as where an obvious supply error has been made by BBA, and where we have been notified of the cancellation of an order within 24 hours will we accept a cancellation of an order. Email sales@beanbagsaustralia.com.au to apply for a cancellation.
If a cancellation of an order is accepted, a 10% cancellation fee may be charged, at our discretion, to the purchaser to cover the merchant service fees and the extra processing required.  

To prevent any disappointment, please ensure that you have carefully considered your choice of purchase and have chosen the correct product. To avoid any unnecessary issue, please review your order carefully before proceeding to checkout.

5. Gift vouchers
Gift vouchers may, or may not be a feature of our store at our discretion. Any verifiable gift voucher will be honoured, provided it is still currently valid. Gift vouchers cannot be refunded or exchanged for another voucher. If your purchase is less than the value of your voucher the difference will not be refunded, nor will a voucher of a lesser value be issued.

6. Warranties / Returns / Exchanges
We will only accept returns which as per the conditions of return covered under the Australian Consumer Affairs Act. All items must be returned to our head office at the responsibility of the sender (customer). The Goods must be returned with a short explanation, upon receipt of an order, and the customer should notify us (by email to sales@Bean Bags Australia.com.au or by phone (08 9244 2600) on the same day if they wish to return an item. The new and unused goods should be returned to us with the original labeling attached, and within 7 days (or 14 Days for international) upon you receiving the goods. New and unused means there is no damage from misuse, marks on the item, or wear or removal of tags and the item has been returned to us in an unused and saleable condition. Bean Bags Australia will not accept returns for any non-faulty items that have been used, washed and/or tags removed. Bean Bags Australia cannot be held responsible for items lost or delayed when being returned. Special orders  (e.g. customized) that are made to your fabric or colour requirements are not returnable unless faulty in manufacture. If applied, shipping charges are non-refundable. International customers must be aware that all international customs duties and sales taxes cannot be refunded. There is no return or exchange for sale items. In the event of an exchange agreed to by our sales manager, items are subject to product availability and the customer will incur any shipping costs for returning items to be exchanged. We can only exchange an item for a different size, style, and colour subject to availability. All inquiries regarding exchange can be made by contacting sales@beanbagsaustralia.com.au or shop@beanbagsaustralia.com.au. Exchanged items can only be dispatched after the returned goods have been received and undergone a quality control check. Any further returns of exchanged items outside the aforementioned  time will be responsibility of the purchaser for the cost of return AND exchange shipping .

7. How to proceed with your return or exchange
Please phone us on 1300 884 385 or email us at shop@beanbagsaustralia.com.au to advise that you would like to make a return or exchange. In your subject heading please state whether you are claiming for a REQUEST FOR RETURN or EXCHANGE REQUEST and provide us with your name provided as the purchaser, your order number and the date.

Securely wrap and package your return or exchange item with the a copy of your return request that you emailed to us, or with a note quoting your order number, date of order and reason for return.

8. Receiving a refund
Once your package has been returned to us within the above stated time frame unless otherwise authorized by the directors at Bean Bags Australia, we will begin to process your refund request. Each item will undergo a thorough quality control check and once verified your refund will be processed in the original payment format as your purchase was made within 30 days of the date of cancellation notice, usually via Paypal as an email payment to the email address supplied for your original order when the Paypal payment  was processed. An order that was not paid with a Paypal account but via Paypal's card services is not affected and will be processed for credit the same way. All undamaged, correctly returned products will be credited to the original name provided to Bean Bags Australia at purchase and registered with PayPal excluding shipping charges and a 10% cancellation fee. You will be notified via email to the address listed on your account when this transaction has taken place. Please note that PayPal or your banking institution may require additional days to process and post this transaction to your account once the payment has been lodged by Bean Bags Australia.

9. Product Modification, Discontinuation and Price changes
Bean Bags Australia reserves the right to change prices without notice. Due to circumstances outside our control, such as changing exchange rates, products and prices that are listed on our site may change over time. Though unlikely to occur, we will nevertheless guarantee that if any of these changes incidentally happen at the very time you are placing your order, you will be duly notified and be given the option of changing or cancelling your order.

10. Product Representation
Computers and mobile devices are not all calibrated to be exact representations of colour, hue or shade. Also, personal screen settings may alter the brightness, saturation or hue of colours. As all representations are subject to the nuances of digital technology from monitors, cameras, printers and such, the colours of the products displayed on our website should not be considered to be anymore than our best effort to demonstrate the actual colours available. We do make a great effort and endeavour to make sure that the colours and fabrics represented in the images are as accurate as possible. We compare the images on various screens and devices to help represent the product as accurately as possible. Fabric and colours may alter due to variation in batch lots from manufacturers. We reserve the right to change colours and fabrics as necessary to improve quality or maintain continuity of supply.  We attempt to keep a continuity of colour and fabric in our range of product, but Bean Bags Australia cannot guarantee that we will be able to match the colours or fabrics of previously purchased products due to changes beyond our control.

11. Product Warnings
Please ensure you read the warnings and care label on receipt of your product. Bean Bags Australia cannot accept any responsibility for damages if the mandatory warning and provided care labels are not observed by the user/s or parties responsible for ownership and use. Polystyrene beans can be flammable if not made with flame retardant - most beans sold and manufactured in Australia are to Australian safety standards. The beans can present a choking hazard as they can easily be inhaled. To prevent children accessing the filling content, all our bean furniture product are fitted with internal and external lockable zips to comply with mandatory Australian Safety Standards .

Never leave children unsupervised with a beanbag. To avoid injury or damage, keep beanbags well away from flame, heaters, cigarettes or anything that might cause the beanbag to burn.

Beanbags can be punctured, causing the beans to spill from the bag. Please ensure sharp objects (like scissors, knives, pens and pencils, etc) do not come into contact with the fabric. The beanbag can easily be re-opened with a piece of wire (e.g. an unfolded wire paper clip).  

Never leave young babies on beanbags unattended, as they may roll face down, causing their breathing to be obstructed on the furniture.

12. Legal claim
Bean Bags Australia is registered and operates from within Australia. The goods are sold in compliance with Australian consumer law. Bean Bags Australia is fully committed and obliged in honouring our responsibilities under Australian Law, according to Australia's Trade Practices Act, Privacy Act and the W.A. Fair Trading Act. Bean Bags Australia does not accept liability for compliance with law in any country other than Australia except where Australia is an agreed signatory to that law. Any legal remedy must take place in Australian law courts.

13. Disclaimer of warranties
You agree that use of the service of our store is at user's sole risk. The product/beanbag is provided on an "as is" basis. Bean Bags Australia expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. Bean Bags Australia makes no warranty that the product will meet the user's requirements, nor do Bean Bags Australia make any warranty as to the results that may be experienced from the use of its products. No advice or information, whether oral or written, obtained by you from Bean Bags Australia shall create any warranty not expressly stated or covered herein. As some jurisdictions do not allow the exclusion of certain warranties, then some of the above exclusions may not apply to you.

14. Liability
You agree that Bean Bags Australia beanbags shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages resulting from the use, misuse or inability to use the product or for cost of procurement of substitute goods or resulting from any goods purchased or obtained or transactions entered into through or from the product or resulting from unauthorised access to or alteration of your transmissions or data or arising from any other matter relating to the product including but not limited to damages for loss of profits, even if Bean Bags Australia has been advised of the possibility of such damages. You further agree that Bean Bags Australia shall not be liable for any damages including but not limited to direct, indirect, incidental, special consequential or exemplary damages. You agree that Bean Bags Australia shall not be responsible or liable to you or to anyone else for the statements or conduct of any third party. Some jurisdictions do not allow the limitation or exclusion of liability for incidental damages so some of the above limitations may not apply to you. Bean Bags Australia's liability to you or any other parties in any circumstances is limited to the value of the bean furniture purchased. Some jurisdictions may not allow this limitation of liability, so these limits on liability may not apply to you.
